Electronic Discovery

Electronic discovery (or e-discovery) refers to discovery in civil litigation which deals with information in electronic format also referred to as Electronically Stored Information (ESI).

Electronic information is different from paper information because of its intangible form, volume, transience and persistence. Also, electronic information is usually accompanied by metadata, which is not present in paper documents.

CFK can professionally handle your e-discovery needs by properly recovering, searching, and organizing all your e-discovery data including e-mails, instant messaging chats, documents, databases, web sites, and any other electronically-stored information which could be relevant evidence in a law suit. Also included in e-discovery is "raw data" which CFK can review for hidden evidence. CFK can also provide your litigators the necessary material from e-discovery in one of several formats including: printed paper, native file format, PDF format, or as single-page TIFF images.

Phases of e-Discovery

The following are phases in the e-Discovery process. This list is not necessarily complete and depending on the specific case, some or parts of these phases may or may not be utilized.

Phase I – Restoring, Copying & Reports

    Restore collected data   
    File Metadata & System Metadata – avoid changing
    Generating reports – identify file types, quantity & volume of data

Phase II – Organizing & Filtering

    Data is extracted from archives (PST, DBX, ZIP, etc.)
    Metadata is exposed (emails & documents)
    Documents culled & de-dupped (hash values)
    Document filters applied (dates, file type, keyword, etc.)

Phase III – Reviewing / Production

    Convert data to universal format – (Native File Review; TIFF, PDF, etc.)
    Hard copy review (printing all docs) & online or in-house review.
    File viewer or e-Discovery reviewer (Catalyst, Concordance, Summation, etc.)
    Documents identified for production & redactions.

Phase IV – Reviewing / Production

    Identified documents are endorsed (bates, confidential, etc.) and produced.
